These are the terms and conditions (“Terms”) that govern your use of this website and any purchase of a Product (“Food Delivery or Collection”). This forms a legal agreement between you, the user of the website and purchaser of any Product(s), and JB Foods Yorkshire Limited ( “we”, “us”, “our”) and you must agree to these Terms in order to purchase a Product(s) If you do not accept these Terms, you should not make any further use of this website and you will not be able to purchase a Product(s).
The website enables you to purchase a Product(s) from our merchants, NOT us. You should ensure that, prior to submitting an order, you review the details of the Product(s), including any conditions and exclusions of the Product(s) and including sur charges for courier and deliveries based on mileage and total amount ordered. Those conditions and exclusions apply in addition to these Terms. Please check your order carefully before submitting it. You can correct errors before submitting the order. Submission of the order constitutes an offer to purchase the Product(s) from us, subject to these Terms. You undertake that all details you provide are correct, that the payment card or bank account is your own and that there are sufficient funds to cover the cost of the Product(s) ordered. We may contact you to say that we do not accept your order. This is typically where the Product(s) are not available, we cannot authorize your payment, you are not eligible to purchase the Product(s), or there has been a mistake in the pricing or description of the Product(s). We will only accept your order when we email you to confirm this. At this point, a binding legal contract will be in place between you and the merchant. You should check that the details in the confirmation are correct and notify us immediately if there is any error.
Due to the volatility of the market and external forces beyond our control, prices are subject to regular fluctuation and therefore “The Company” has the right to change/ increase prices or reject processing of goods without notification to both and all traded and non-traded customers. External forces will and do include war, famine, political revolutions, commodity shortages such as wheat and eggs, climate and geographic repercussions, exchange rates and high demand all contribute towards price fluctuations.
We accept payment by credit or debit card (Visa, Mastercard, or American Express) or PayPal. Payments are processed via our nominated third-party payment processor. Your payments are directly remitted to the merchant you are purchasing food from. You are NOT paying us.
Some of our products are subject to availability to purchase and in the event whereby we are unable to process your order because of low or no stock levels, you will receive a notification and advice of how best to proceed with your order.
Your right to cancellation starts at the time of placing your order. Please note that as all of our products are perishable goods, your right to cancel will cease 24 hours before dispatching or collection of your order. This is non-refundable.
Our standard operating hours are Monday to Friday (excluding Bank Holidays) from 8am to 5pm and Saturday from 9.00am to 1.00pm.
All trade account-based customers must undertake our Credit Application and Verification process prior to release of goods. All payments must strictly be debited into our account as set out in the credit agreement. The Company has the right to reject any credit proposals and operate on a Proforma basis in the interest best serving the business. Any short payment will result in the account being ‘On Hold’ and the management has the right to reject processing/ delivery/ collection of goods until payment has been received.
It is the responsibility of the customer(s) to sign their dispatch dockets/ notes and to check the quantity and product dispatched. Our delivery team will only unload the product to a suitable area as close to the refrigeration as possible. In the interest and welfare of our employees, they will not: carry product to any area they feel is a hazard or has the potential to cause and inflict injury. This includes staircases, chillers, fridges, uneven surfaces.
We will not tolerate any abuse towards our staff.
The Company will undertake all legal action in the event of both non or partial payment and the legal costs will be borne by the customer.
Any use of Company issued assets such as pallet and trays need to be returned in full. The Company has the right to exercise full payment of non-return of said assets and will resort to legal action to reclaim any and all losses.
